Terms of Service

The short version

Place of Rest is a free grave locator. You can search and view public memorial records without an account. If you sign in with Google, you can save private lists of graves and share a list with people you choose. These terms cover that use. How we handle personal data, including information received from Google, is set out in our Privacy Policy.

1. Agreement

These terms apply to your use of Place of Rest at placeofrest.uk, including browsing memorial records and creating an account. By using the site, or by signing in with Google, you agree to these terms and to our Privacy Policy.

If you do not agree, do not use the site and do not sign in. The service is not directed at children under 13. If you are under 18, you may use an account only with a parent or guardian's agreement to these terms.

2. Who we are

Place of Rest is operated by Element Software, a software development company based in Leicester, United Kingdom. References to “we”, “us” and “our” mean Element Software in relation to this service.

3. The service

Place of Rest helps people find a grave. You can search memorial records, view the recorded location on a map, and use your phone for walking directions where location data is available. The service is free.

Records come from public headstones and memorials, cemetery burial records, and community contributions that we review before publication. Coverage varies by cemetery and is not complete. A person not appearing in search does not mean they are not buried there.

4. Accounts and Google sign-in

An account is optional. Searching and viewing public memorial records does not require one. The only way to create an account is to sign in with Google. Signing in lets you save lists of graves and manage those lists.

When you choose Sign in with Google, you authorise Google to share your Google account name, email address and profile picture with Place of Rest. We use that information only to create your account, recognise you when you return, and provide the features tied to your account, such as the lists you save.

We do not:

  • Sell information received from Google
  • Use it for advertising, or to build advertising profiles
  • Use it for any purpose other than running your Place of Rest account
  • Share it with third parties except the providers named in the Privacy Policy who help us host the site, keep you signed in, and — only if you allow analytics — understand how the product is used

Signing in sets an essential session cookie so you stay logged in. You can sign out at any time from your account page. To ask us to delete your account and the lists associated with it, use the contact page. We delete account data within 30 days of a verified request, as described in the Privacy Policy.

You are responsible for the Google account you use to sign in. Do not leave a signed-in session open on a shared device if you do not want someone else to see or change your lists.

5. Saved lists and sharing

Lists you create are private to your account unless you choose to share one. A shared list has a link. Anyone with that link can view the list without signing in. Sharing is your choice: Place of Rest does not send the link to anyone on your behalf.

You can turn sharing off, or generate a new link, which stops the previous link from working. List names and descriptions are visible to anyone you share the list with, so avoid putting private information there that you would not want a recipient to see.

Memorial records on a list are the same public records shown elsewhere on the site. We may remove a list, or turn sharing off, if it breaks these terms.

6. Contributions

You may submit missing memorial information, grave locations, photographs and corrections. Submissions are also covered by our Contributions Policy. We may review, edit, reject or remove a submission.

You confirm that you have the right to provide what you submit, and you grant Place of Rest permission to store, edit and publish it so that visitors can find the grave. You keep ownership of photographs you took. Do not submit information or images you are not entitled to share.

7. Acceptable use

You agree not to:

  • Use the site for anything unlawful, or to harass, abuse or threaten anyone
  • Submit memorial information you know to be false
  • Upload photographs you do not have the right to share, or photographs that show identifiable living visitors where that can reasonably be avoided
  • Try to access another person's account, private lists, or non-public parts of the site
  • Scrape, overload, disrupt or interfere with the site or its security
  • Misrepresent your identity when contacting us about an account or a memorial record

We may suspend or close an account, or remove content, where we reasonably believe these terms have been broken.

8. Accuracy of memorial information

We aim for records to match the headstone or burial record they came from, but they can be incomplete, out of date or wrong. Maps, plot references and walking directions are a guide to help you look. They are not a guarantee of a grave's location, and cemetery grounds can be uneven. Check your surroundings and follow any rules the cemetery sets.

9. Intellectual property

The Place of Rest name, design and software are owned by Element Software or its licensors. You may use the site for personal, non-commercial purposes consistent with these terms. You may not copy the site's design or software, or present the service as your own.

Inscriptions transcribed from public monuments are published so that people can find a grave. That does not transfer any separate right you may have in a photograph or other material you submit, beyond the permission described in section 6.

10. Privacy

Our Privacy Policy explains what information we collect from people who use the site, what we receive when you sign in with Google, and the rights you have over your account data. The Privacy Policy forms part of these terms.

11. Availability and changes

Place of Rest is provided free of charge. We may change, pause or withdraw features, including accounts and lists, and we do not promise that the site will always be available or error-free.

If we make a material change to these terms, we will update the date at the top of this page and, where appropriate, let signed-in users know. Continuing to use the site after the change takes effect means you accept the updated terms. If you do not accept them, stop using the site and ask us to delete your account.

12. Liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot legally be excluded or limited under the laws of England and Wales. Nothing in these terms affects your statutory rights as a consumer.

The service is free. Subject to the paragraph above, we are not liable for loss or damage arising from your use of, or inability to use, Place of Rest, including reliance on a memorial record, map or set of directions, or from a list or account being unavailable. We are not responsible for Google's services, including Google sign-in being unavailable.

13. Governing law

These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you live in another part of the United Kingdom you may also bring a claim in the courts of your home country.
